Denial of Petition to Remove California Same-Sex Marriage Amendment from Ballot

The California Supreme Court Wednesday denied a petition filed by several advocacy groups to remove the same-sex marriage measure from the November ballot, which will allow voters to decide whether to amend the state constitution limiting the institution of marriage to a man and woman. If the measure passes, it will overturn the May 15th California Supreme Court ruling that legalized gay marriage in the state.

Equality California, the National Center for Lesbian Rights, Lambda Legal, and the American Civil Liberties Union argued that the measure violated the fundamental rights of gay persons and that it constituted a revision rather than an amendment, requiring it to be submitted to voters by a two-thirds majority of the state legislature. The court did not comment on its decision.
