Civil rights organizations filed a writ petition Wednesday with the California Supreme Court claiming that the recent voter-approved state constitutional amendment to ban same-sex marriage denies the constitutional rights of a particular group of citizens. The groups claim the amendment is invalid, because it actually constitutes a consititutional revision that requires legislative approval.
The petition, which was brought by the American Civil Liberties Union, Lambda Legal, the National Center for Lesbian Rights on behalf of Equality California and six unmarried same-sex couples, also asks the court to preclude enforcement of the amendment pending the outcome of the case.
