			<content:encoded><![CDATA[<p>The 9th U.S. Circuit Court of Appeals has found Yahoo not responsible for nude photos posted on its website by outside parties. An Oregon woman brought a lawsuit in 2005, suing Yahoo for allowing her ex-boyfriend to create a profile for her with nude photos included, and posing as her in an online chat room to solicit sex without her knowledge or permission.</p>
<p>The court said Yahoo was protected under a 1996 federal law that gives broad immunity to service providers to encourage the open exchange of material on the Internet by its users. The court&#8217;s ruling left open the possibility that Yahoo may be liable for promising to remove the offending materials and information. The plaintiff claimed that a Yahoo official promised to immediately remove the photos when a local TV station was preparing a report, but failed to carry out the promise.</p>

			<content:encoded><![CDATA[<p>Overstock.com , an online retailer, announced today that the company has settled all claims in a defamation lawsuit it had filed against Gradient Analytics.</p>
<p>Overstock filed suit against Gradient in 2005 and alleged that the company had conspired with a partner to write negative research reports and drive down the price of its stock.</p>
<p>Gradient released the following statement concerning research reports it previously published about Overstock: &#8220;Having reviewed all SEC filings, relevant accounting literature, and all other information available to it, Gradient now believes that, to the best of its knowledge, Overstock&#8217;s stated accounting policies did in fact conform with Generally Accepted Accounting Principles (GAAP) and regrets any prior statements to the contrary.&#8221;</p>
<p>The terms of the settlement are confidential.</p>

<p>Allegheny County Judge R. Stanton Wettick Jr. ruled that he did not have juridisdiction in the case and that it should be brought in Florida, where the website originates. </p>
