			<content:encoded><![CDATA[<p>The Supreme Court is set to hear a case to decide whether taxpayers must pay for special education classes at private schools. The student in the case is seeking reimbursement from the Forest Grove School District in Oregon for a private school special education program that costs $6,400 a month.  Under the federal  Individuals with Disabilities Education Act, a learning disability may qualify a student for special education. If a district is unable to provide special education services for a student, it must pay to send the student to a school where she or he can find those services.</p>
<p>The student suffers from ADHD, learning disabilities and depression. However, the school district found him ineligible for special education,  so he did not receive special education services. The court will decide whether parents who unilaterally enroll their disabled child in a private school are entitled to tuition reimbursement if the child never received special education from the district.</p>
