ACLU & MALDEF File Suit Againt Texas Suburb

The American Civil Liberties Union and The Mexican American Legal Defense and Education Fund today filed a request for a temporary restraining order to block implementation of an anti-illegal immigrant rental ordinance. The ordinance approved by Farmers Branch residents last Saturday would prohibit landlords from leasing apartments to most illegal immigrants. It would also requires persons wishing to rent an apartment to show proof of U.S. citizenship or that they are legal immigrants.

“It is unfortunate that the residents of Farmers Branch have chosen to implement a law which is not only bad policy, but is likely also unconstitutional,” said Lisa Graybill, Legal Director for the ACLU of Texas.  “Now the issue will have to be resolved in federal court.”

The ordinance is scheduled to go into effect on May 22, 2007.
