9th Circuit Extends Stay on Don’t Ask Don’t Tell Policy

The U.S. Court of Appeals for the Ninth Circuit has ordered an indefinite extension of its temporary stay which prevents the suspension of the military’s “Don’t Ask Don’t Tell” (DADT) policy. The order follows an injunction issued by the U.S. District Court of the Central District of California that required the US military to end enforcement of DADT.

The policy banning openly gay service members has been challenged as unconstitutional. Since the enactment of DADT in 1993, approximately 13,000 servicemen and women have been discharged from the armed forces under the policy. Gay Americans who disclose their sexual orientation cannot enlist in the armed forces and can be investigated and ultimately discharged.  In May, the House of Representatives and the Senate Armed Services Committee (SASC)  voted to repeal the policy after President Barack Obama and Defense Secretary Robert Gates agreed to a compromise that would delay a repeal until after a review of the effects the repeal would have on military effectiveness, soldier retention and family readiness.
